1. Account Setup and Order Acceptance
Your account will be activated upon receipt of payment. To complete an order, submit the payment through the designated methods (bKash payment, Cryptomus, Binance Pay, Stripe, Bank Transfer, or Any offline payment), and confirm with our support team. It is your responsibility to ensure that the email address registered in your client area is current and accurate before making a payment. All account-related information will be sent to the verified email address. CloudWave Bangladesh will not be held liable for any issues arising from incorrect or outdated contact details.
2. Payments
All services provided by CloudWave Bangladesh are prepaid. Upon placing an order, full payment must be made via the accepted payment methods. Renewal reminders will be sent 7 days & 3 days before the renewal date. Failure to renew services by the due date will result in the suspension of hosting and domain or any other services, with no liability for data loss. Your account will be set up for our services after payment is confirmed. We encourage payments via bKash for convenience.
3. Refunds
CloudWave Bangladesh offers a 7-day money-back guarantee for hosting packages. If you are dissatisfied with our service within this period, please provide a valid reason, and we will issue a full refund. Please note that domain registration, VPS servers, dedicated servers, and any license and software fees are non-refundable. Any service-related fees like account migration, server configuration, IT support charges &, etc. are not refundable.
4. Content Usage and Restrictions
All services provided by CloudWave Bangladesh must be used for lawful purposes only. You agree to comply with applicable laws, including the Bangladesh Cyber Act 2006, and to indemnify CloudWave Bangladesh against any claims arising from misuse of our services. The following content and activities are prohibited:
- Emails spamming, phishing websites, and mail sending
- Distribution or hosting of copyrighted or trademarked material without permission
- Sale of counterfeit merchandise or materials infringing trademarks
- Adult content, child exploitation materials, and illegal images/videos
- Proxy scripts, IRC bots, warez, or pirated software
- Unlawful content, hate speech, or harassment
- Promotion of illegal activities, including gambling, fraud, and pyramid schemes
- Hosting large multimedia files, backups, or archiving files unrelated to website operation
- Excessive use of server resources (including databases and storage)
Failure to adhere to these policies will result in suspension or termination of services without a refund.
5. Account Suspension and Termination
We reserve the right to suspend or terminate your account in the following circumstances:
- Non-payment
- Violation of content policies or misuse of server resources
- Abuse, including sending spam or hosting phishing/malware-related content
- Security threats or network attacks originating from your account
We collaborate with third-party data centers, and by using our services, you accept their terms and conditions. No refunds will be issued for servers, licenses, software, or services if you violate our rules.
6. Usage Policy for Unlimited Plans
Certain hosting plans may offer “unlimited” disk space, bandwidth, and storage. However, these resources are intended for normal website operation only. The following restrictions apply:
- Unlimited resources do not extend to file storage or archiving activities, such as backups or large multimedia storage.
- Excessive use of server resources, such as databases or file numbers, may lead to performance degradation and could result in account suspension or the need to upgrade to a more suitable hosting plan.
7. Spam and Server Abuse
We have a zero-tolerance policy towards unsolicited email, spam, or bulk emailing. Any customer found sending spam will have their account terminated immediately, with or without notice. Any attempt to undermine or harm our servers will result in immediate deactivation of your account.
8. Bandwidth
If your account exceeds its bandwidth allowance, you will be notified. If you do not wish to upgrade your account, it will be suspended until the following month, after which it will be reactivated. Excessive bandwidth usage may result in the need to upgrade your hosting plan.
9. Backups
CloudWave Bangladesh will make reasonable efforts to back up your data; however, we do not guarantee the existence or accuracy of backups. You are solely responsible for maintaining your own backups. We will not be held liable for any data loss.
10. Uptime Guarantee
CloudWave Bangladesh guarantees 99.9% uptime for shared hosting services, excluding scheduled maintenance. If your hosting account experiences downtime beyond this limit, you may be eligible for a credit, as defined in our Service Level Agreement. Third-party monitoring services may not be used to justify claims.
11. Scheduled Maintenance and Downtime
Scheduled maintenance and repair activities are not covered under the uptime guarantee. We will notify customers in advance of any planned maintenance.
12. Disclaimer of Liability
CloudWave Bangladesh is not responsible for any damages, including data loss, business disruptions, or interruptions caused by our services. We do not provide any warranties or guarantees, either express or implied, regarding the services provided. This includes loss of data due to delays, mis deliveries, or service interruptions.
13. Modification of Terms
CloudWave Bangladesh reserves the right to modify these Terms and Conditions at any time without prior notice. By continuing to use our services, you agree to be bound by the revised terms.
